THE Department of Justice has reinstated the Bureau of Immigration’s deportation order against Chinese fugitive Wang Bo.
Justice Secretary Leila de Lima reinstated the deportation order.
In her 12-page resolution, De Lima set aside the May 21, 2015 resolution of the BI’s Board of Commissioners and ruled in favor of the deportation of Wang Bo.
However, the implementation of the deportation order was held in abeyance pending investigation into the alleged bribery case and suspicious circumstances surrounding the delay in the implementation and eventual reversal of the summary deportation order.
“It should be remembered that in deportation proceedings, the foreign national bears the onus of proving that he should not be deported and his sojourn in the Philippines is legal. Here, in the light of the legal presumption of regularity of the Chinese Embassy’s performance of its official acts, the foreign national should have presented clear and convincing evidence to the effect that his entry and stay in the Philippines is licit. The dissenting Associate Commissioners, instead, would reverse the presumption, from one of regularity to one of questionable origin, and in so doing putting into issue the very government in the planet, i.e., representation of the official business of the foreign government in the host country,” De Lima said in her resolution.
The resolution pointed out a number of irregularities in the proceedings and the collateral events that led to the reversal of the summary deportation order, one of which was the effort to conjure a legal basis to prevent Wang Bo’s deportation by the latter’s lawyer who filed two apparently manufactured criminal complaints against his own client (Wang Bo).
Also noted was the phone call request of one associate commissioner to implement the exclusion to Malaysia instead of the deportation to China; the more than one month delay in the enforcement of the deportation order; the sudden change in opinion of the Board of Commissioners as to the value of the representations of the Chinese Embassy; the immediate issuance of Wang Bo’s release order on the same date as the 21 May 2015 reversal of the deportation order; and the highly inappropriate use of international political considerations as an excuse for undermining the value of Chinese Embassy representations.
Wang Bo’s case has earned media attention over the past weeks, primarily for the alleged P400-million bribe to prevent his deportation to China. The timeline of events are as follows:
Wang Bo arrived in the country on February 9, 2015 under a cancelled passport and with the information that he is a fugitive in China. He was admitted for the purpose of deporting him to China.
On March 5, 2015, a summary deportation order, signed by Commissioner Mison, and Associate Commissioners Mangotara and Repizo was issued against Wang Bo.
On April 21, Wang Bo’s lawyer filed an urgent motion for reconsideration, which was granted on May 21 on grounds of due process and rules on admissibility of foreign documents.
On May 26, the board of commissioners, upon the directive of Commissioner Mison, re-evaluated the April 21 resolution but Assoc. Comms. Mangotara and Repizo voted to sustain the same.
On May 27, Secretary De Lima directed to hold in abeyance Wang Bo’s release.
Last Tuesday, members of the BI’s Board of Commissioners were investigated by the House Committee on Good Governance and Public Accountability on the Wang Bo controversy. Mison, Mangotara, and Repizo all denied the bribery allegations.
Support for Mison
An anti-corruption group, the Anti-Trapo Movement of the Philippines (ATM), Inc. has declared their support for Bureau of Immgiration (BI) Commissioner Siegfred B. Mison, who has been implicated in the alleged payoff to stop Wang’s deportation and have him released from BI detention.
Ka Leon Estrella Peralta, Founding Chairman of ATM, said “if there is one honorable and incorruptible public servant whom our dear President PNoy has appointed for government service, Commissioner Mison befits and exemplifies this.”
A news report has said Wang provided grease money to congressmen to fund the passing of the controversial Bangsamoro Basic Law (BBL) draft in the Lower House.
Peralta said: “ATM likewise praises and support the impartial stance of our honorable Secretary of Justice Leila de Lima, in confronting the issue, primarily showing that the reported allegation of bribery/extortion in the deportation case, is best resolved only through an uncompromised due process and credible investigation, where any findings of malfeasance or criminal liability by those allegedly involved will hence be brought before the bar of justice.”
Wang was being sought by Interpol and the Chinese government for allegedly embezzling $100 million.
Wang has been detained at the BI jail in Taguig City since his arrest on February 10 upon his arrival at the Ninoy Aquino International Airport (NAIA) from Malaysia.
The Chinese Embassy sought the BI’s assistance in apprehending Wang, whose passport had already been cancelled.
Mison said that on March 5, the Board of Commissioners issued a summary deportation order against Wang but on May 21, the BI board granted Wang’s request and removed his name from the blacklist.

LTO gets criticized over new vehicle plates’ bad quality

The Land Transportation Office (LTO) is being bombarded with criticisms and complaints over the new car plates they issued on all motor vehicles – whether old or new.

Complaints range from the easily chipped off paint of the plate or to the badly-shaped screws. The paint supposedly has a reflectorized quality and was promised to be long lasting but it is easily removed. Some complaints said the paint lasts for only a month. Gregorio Larrazabal, former Comelec commissioner said he noticed that the black paint that was used for the numbers on the plates did not live up to the standards that the LTO claimed. They said the paint was scratch free and it does not seem to be.
The installment of the new plates on cars is also reportedly difficult because they do not fit certain types of vehicles.

There is now a clamor for an investigation on the matter because the new vehicle plate project has an estimated cost of P3.8 billion. All motorists have been forced to pay even though their vehicle plates do not need replacements.

Senate President Pro Tempore Ralph Recto is now pushing for a look into these vehicle plates and proposing that a reimbursement be issued to those who have purchased their new plates.
Recently, the LTO also announced that motorists may finally be able to get their driver’s license in the next few months. The supply contract for the 5 million drivers’ license cards has now been awarded by the government.

The Allcard Plastics Philippines Inc. was awarded the license project by the Department of Transportation and Communications (DOTC). Currently, the validity period of temporary driver’s licenses was waived due to the shortage of supply and materials.
Allcard won the contract for the licenses for having the lowest bid of P336.868 million or 25.3 percent lower than the P450-million approved budget of the project.

“We are pleased to report that license cards will soon be available at all LTO offices. We will strive to ensure that the implementation of this project will run smoothly in order to reinstate these basic services provided by the LTO,” Joseph Emilio Abaya, Transportation and Communications Secretary, said in an official statement last Friday.

    PROBLEMS on the issuance of license plates for motor vehicles by the Land Transportation Office (LTO) are seen likely to worsen because the Commission on Audit (COA) has suspended payment of the P3.8-billion cost of the contract.
    At the resumption of the Senate blue ribbon committee hearing on Monday, Sen. Joseph Victor Ejercito said the situation could deteriorate if the LTO, headed by Alfonso Tan, would fail to provide the documents being demanded by the COA, which is auditing the multibillion-peso procurement contract.
    “If this suspension notice of COA will prosper, it will surely delay further the issuance of the vehicle license plates,” Ejercito told reporters after the hearing.
    The COA issued a notice of suspension of payment on April 10, 2015 after the LTO failed to submit several documents being asked by state auditors who are scrutinizing the contract awarded to Power Plates Development Concepts Inc. and Dutch firm J. Knierem BV-Goes (JKG) in 2013.
    Based on the Audit Observation Memorandum (AOM) of COA dated November 17, 2014, a copy of which was obtained by The Manila Times, the state auditor enumerated 10 documents that were lacking, among them—a detailed breakdown of the approved budget of the contract (ABC); minutes of pre-procurement conference; result of the bid evaluation; eligibility check/screening; abstract of bids; post-qualification evaluation report; bid security; and other documentary requirements.
    During the hearing, Leo Romero, counsel of bidder Marianing and Sons Development Corp., asked the audit body if the LTO had submitted a certificate of availability of funds for the contract.
    Romero explained to the committee that under the Procurement Law, two prerequisites are needed to make the contract valid: a certificate of complete appropriation for the project and a certificate of availability of funds.
    “If any one of these requisites is absent, then the contact is null and void ab initio [from the start],” Romero said.
    Cecilia Camon, COA Director IV, could not categorically say if COA received the certifications.
    Ejercito asked Transportation Undersecretary Jose Lotilla, chairman of the 2013 Bids and Awards Committee on the license plates bidding, if his department has submitted the certification to COA. Lotilla refused to answer, saying the matter could be sub judice since there is a pending case at the Supreme Court in relation to the issue.
    In the end, Sen. Alan Peter Cayetano moved that a subpoena be issued to compel the COA to submit the notice of suspension of payment to the committee, which was seconded by Sen. Nancy Binay.
    The LTO already paid Power Plates-JKG P477 million for mobilization expenses but if the agency fails to submit the documents being demanded by COA within the prescribed time, a notice of disallowance will be issued to the LTO.
    The notice of disallowance, in effect, will nullify the contract and Power Plates-JKG will be compelled to return all payments it has received from the LTO.
    Tan tried to downplay the suspension of payment order issued by the COA.
    He said the LTO had been coordinating with the Department of Transportation and Communications because the documents will be coming from the agency.
    Tan added that the COA order will not affect the release of license plates because the supplier continues to produce the plates.
    When asked about the poor quality of license plates that the LTO has received, he said the plates were randomly inspected by the Department of Science and Technology (DOST).
    Ejercito moved to invite DOST officials to the next hearing to shed light on the matter.
    Last week, Edward Fereira, a bidder, told the Senate that the new license plates lacked the security features promised by the Power Plates-JKG on its bid offer.
